1. About these terms
These Terms of Service govern your use of sentimentsbytall.com and purchases from Sentiments by TALL, Inc. (“Sentiments by TALL,” “we,” “us,” or “our”). By using the website, submitting a custom request, or purchasing a product or subscription, you agree to these terms.
2. Products and custom work
We create customized, handcrafted luxury décor for memorial tributes, ceremonies, meetings, celebrations, and special events. Because many pieces are handmade or personalized, photographs are representative and reasonable variations in color, texture, placement, materials, and appearance may occur. Customers are responsible for reviewing names, dates, photographs, wording, colors, measurements, delivery details, and other personalization before approving an order.
3. Orders, pricing, and payment
Prices are shown in U.S. dollars unless stated otherwise. Taxes, delivery, shipping, rush service, customization, installation, or other charges may be added when applicable and will be shown before payment or confirmed in the applicable quote. An order is accepted when we confirm it and receive any required payment or deposit. We may decline or cancel an order and refund amounts paid if materials are unavailable, the requested completion date cannot reasonably be met, or the request conflicts with law or our policies.
4. Custom-order changes and cancellations
Contact us promptly if an order must be changed or canceled. Changes are not guaranteed after materials have been ordered or production has begun and may affect price or timing. Custom, personalized, perishable, used, installed, clearance, and final-sale items may be nonreturnable except where required by law or when we confirm that an item arrived damaged or materially different from the approved order. Any order-specific written quote or agreement controls if it conflicts with this general section.
5. Subscriptions and recurring plans
If you enroll in a recurring plan, Stripe will charge the payment method on file at the price and interval shown at checkout until the plan is canceled. You may update billing information, view invoices, or cancel through the customer portal. A cancellation takes effect at the end of the current paid billing period, so access and included benefits continue until that date and the next renewal is not charged. Fees already paid for the current period are not prorated unless required by law or stated in a separate written agreement.
6. Completion, pickup, delivery, and shipping
Requested dates are important planning targets, but are not guaranteed until confirmed by us. Timing may be affected by design approval, customer responses, material availability, carriers, weather, venue access, or events outside our reasonable control. Risk of loss transfers as permitted by applicable law upon delivery, pickup, or tender to the carrier. Customers must provide accurate delivery and contact information and promptly inspect the order.
7. Customer-provided content
You represent that you have permission to provide and authorize our use of any photographs, names, logos, artwork, music, text, trademarks, or other content submitted for an order. You grant us a limited license to use that content solely to communicate with you, design, produce, deliver, support, and document your order. We may refuse material that appears unlawful, infringing, hateful, deceptive, or unsafe.
8. Intellectual property
The website, original product designs, photographs, text, graphics, branding, and other content owned by Sentiments by TALL are protected by applicable intellectual-property laws. Except for personal use connected with a purchase, no content may be copied, sold, reproduced, or commercially exploited without written permission.
9. Website and service availability
We may update the website, products, prices, or services at any time. We do not promise that the website will always be uninterrupted or error-free. Links to third-party services are provided for convenience; their separate terms and privacy practices apply.
10. Disclaimer and limitation of liability
To the fullest extent permitted by law, products and services are provided without warranties beyond those expressly stated in writing or required by law. Sentiments by TALL will not be liable for indirect, incidental, special, or consequential damages. Our total liability arising from a particular order will not exceed the amount paid for that order, except where a limitation is prohibited by law.
11. Governing law
These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Before filing a formal claim, each party agrees to make a good-faith effort to resolve the issue by contacting the other party. Nothing in these terms limits any non-waivable consumer right.
12. Changes to these terms
We may revise these terms by posting an updated version and effective date. Changes apply prospectively unless law requires otherwise.
